These Terms of Service govern access to and use of RealMoment.ai, including our website, dashboard, generation tools, billing features, exports, and related services.

By creating an account, starting a subscription, uploading content, or using the service on behalf of a client or organization, you confirm that you have authority to accept these terms for yourself and that organization.

RealMoment.ai helps agencies and businesses upload source photos, generate creative variations, organize client workspaces, compose ad assets, and export outputs for advertising workflows.

The service may use third-party infrastructure, storage, payment, authentication, workflow, and AI providers to process requests and deliver outputs. Features may change as the product improves.

You are responsible for keeping account credentials secure and for all activity under your account. If you manage work for clients, you are responsible for your users, contractors, client workspace setup, approvals, and end use of exported creative.

You may not share accounts in a way that avoids plan limits, weakens security, or gives unauthorized people access to client materials.

You keep ownership of photos, logos, prompts, copy, brand materials, and other content you upload. You grant RealMoment.ai the limited rights needed to host, process, transform, display, and deliver that content through the service.

You confirm that you have all rights, releases, permissions, and client approvals needed to upload the content and create ad creative from it, including permissions from recognizable people, property owners, employers, patients, customers, staff, models, photographers, and brand owners when required.

• Do not upload content you do not have permission to use.
• Do not upload medical records, patient files, financial records, government IDs, or other regulated sensitive data unless RealMoment.ai has agreed in writing to support that use.
• Do not upload images of children or vulnerable people without clear legal authority and consent.
• Do not use the service to impersonate a person, mislead viewers about endorsements, or create unlawful advertising.

Subject to your compliance with these terms and payment obligations, you may use generated outputs for your business and client advertising. Because outputs are AI-assisted, you are responsible for reviewing them before use.

RealMoment.ai does not guarantee that outputs are accurate, unique, non-infringing, compliant with ad-platform rules, compliant with laws, or effective for marketing performance. You are responsible for claims, offers, disclosures, likeness approvals, before-and-after imagery, professional licensing rules, regulated-industry requirements, and platform review.

You may not misuse the service, interfere with its operation, reverse engineer protected systems, bypass usage limits, probe for vulnerabilities, scrape data, resell access without permission, or use automated access in a way that harms the platform.

You may not use RealMoment.ai to create, upload, or distribute unlawful, deceptive, hateful, exploitative, sexually explicit, harassing, violent, infringing, privacy-invasive, or harmful content. We may remove content, limit generation, suspend accounts, or report activity when needed to protect users, clients, the public, or RealMoment.ai.

Paid plans, credits, overages, workspace limits, and billing cycles are shown in the product or on our pricing page. Fees are charged through our payment processor and may include taxes where applicable.

Credits and plan allowances may expire, reset, or be limited by the plan terms shown at purchase. Unless required by law or expressly stated in writing, fees are non-refundable, and unused credits have no cash value. You are responsible for cancelling before renewal if you do not want to continue a paid plan.

The $8 Starter Pack is final sale and has no refund window. It includes one client workspace and Design credits; Scenario, Story Mode, and Refine require a subscription. Starter Pack credits do not expire, and if you later subscribe to another plan, remaining Starter Pack credits stay available and are used before subscription credits.

We work to keep the service reliable, but RealMoment.ai is provided on an as-available basis. AI providers, queues, payment processors, storage providers, and hosting providers can experience delays or outages outside our control.

Some features may be experimental, beta, or subject to generation limits. We may change, pause, or discontinue features when needed for security, legal, operational, or product reasons.

We treat non-public customer materials with care and use them to provide, secure, support, and improve the service as described in our Privacy Policy. You should not upload highly confidential materials unless you are comfortable with the processing described in these terms and our Privacy Policy.

If you send suggestions, bug reports, or product feedback, you allow RealMoment.ai to use that feedback without restriction or compensation.

You may stop using the service or cancel a paid plan at any time. We may suspend or terminate access if you breach these terms, create risk for others, fail to pay, misuse the service, or if continued access would create legal or security exposure.

After termination, we may retain limited records as needed for billing, security, legal compliance, dispute handling, backups, and legitimate business operations.

To the fullest extent allowed by law, RealMoment.ai is provided without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted operation.

You are responsible for human review of all generated creative before publication, especially where advertising claims, professional services, health-related content, financial decisions, endorsements, testimonials, pricing, promotions, or regulated services are involved.

To the fullest extent allowed by law, RealMoment.ai will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, advertising losses, platform disapprovals, client churn, or business interruption.

To the fullest extent allowed by law, RealMoment.ai's total liability for any claim will be limited to the greater of USD $100 or the amount you paid to RealMoment.ai for the service in the three months before the event giving rise to the claim.

You will defend, indemnify, and hold harmless RealMoment.ai from claims, losses, liabilities, damages, costs, and expenses arising from your content, generated-output use, client relationships, advertising claims, breach of these terms, violation of law, or violation of another person's rights.

We may update these terms as the service, law, and business needs change. If changes are material, we will take reasonable steps to notify users. Continued use after the effective date of updated terms means you accept the updated terms.
